1. Important Information

A. Purpose of This Privacy Policy

This Privacy Policy governs our collection, use, maintenance, protection, disclosure, and processing of Personal Data (as defined below), including Personal Data we collect on or through the Services, and in email, text, and other communications relating to the Services. This Privacy Policy applies to Personal Data collected in connection with products and services offered by Inpro or from other interactions with us where a link or other appropriate reference of incorporation to this Privacy Policy is made.

Except as otherwise provided in this Privacy Policy, this Privacy Policy does not apply to Personal Data that:

  • is collected through any applications or websites other than those included in the Services, including websites you may access through or may be linked to by the Services; or
  • which you provide to or which is collected by any third party.

It is important to read this Privacy Policy in conjunction with any other privacy policy or fair processing notice we may provide on specific occasions when we are collecting or processing Personal Data so that you are fully aware of how and why we are using that data. C. No Collection of Information from Children

The Services are not directed to nor intended for use by anyone under eighteen (18) years of age (“Unauthorized Users”).  If you are an Unauthorized User, do not use the Services or provide any Personal Data, on, or through the Services.

Inpro does not knowingly collect or retain any Personal Data from children under the age of sixteen (16). If Inpro learns that we have Personal Data on a child under the age of sixteen (16) or equivalent minimum age under applicable privacy laws we will take steps to delete that information from our systems. We will delete any Personal Data that we learn was collected from a child under the age of sixteen (16).  If you believe we have collected Personal Data from a child under the age of sixteen (16), please contact us as provided in Section 1.B.

D. Changes to this Privacy Policy; Updating Your Personal Data

Inpro reserves the right to review and update this Privacy Policy at any time. Any such revisions will be effective on the date of posting to www.inprocorp.com and, to the extent permitted by applicable law, will apply to all information collected by Inpro both prior to and following the effective date. Users should visit this page periodically to review the current privacy policies.

It is important that the data we hold is accurate and current. Please keep us informed if your Personal Data changes during your relationship with us.

E. Third Party Links

The Services may include links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not have control over third-party websites and are not responsible for their privacy policies. When you leave the Services, we encourage you to read the privacy policy of every website you visit.

2. The Personal Data We Collect 

“Personal Data”, as referenced in this Privacy Policy, means any information by which you may be personally identified, or that relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with you (such as a name, email address or identification number). “Personal Data” does not include information which is generally not considered “personal information” or “personal data” under applicable law, such as information which is publicly available or which is subject to special data privacy laws and/or regulations (such as “protected health information” covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA)). “Personal Data” also does not include Non-Personal Data (as defined below).

We may collect, use, store, transfer and otherwise process different kinds of Personal Data about you:

  • Identity data: may include first name, maiden name, last name, and title.
  • Contact data: may include billing address, delivery address, email address, fax numbers and telephone numbers.
  • Financial data: may include bank account and payment information.
  • Transaction data: may include payment details, products and services details you have purchased from us.
  • Technical data: may include internet protocol (IP) address, login data, browser type/version, time zone and location, operating system/platforms, referring sites, and other technology on the devices you use to access the Services.
  • Profile data: may include username and password, your purchases, type code, industry information, customer account number, feedback, and survey responses.
  • Usage data: may include information about how you use the Services.
  • Marketing and Communication data: may include marketing preferences and your communication preferences.

We may also connect information which is about you but does not identify you (“Non-Personal Data”), such as traffic data, location data, logs of the date and time of your visits with the Site and/or Services, click-stream data, and other information which has been de-identified or aggregated in a manner where it can no longer be used to identify you. Non-Personal Data may be derived from your Personal Data but has been aggregated or anonymized to prevent its ability to reveal your identity directly or indirectly.

We do not collect any special categories of Personal Data, such as details about your race, ethnicity, religious or philosophical beliefs, political opinions, health, or biometric data. Nor do we collect any information about criminal convictions and offenses.

3. How Your Personal Data Is Collected

In connection with our operation of the Services, we collect Personal Data in the following ways:

  • Through automated technologies or interactions via the Services; or
  • From third parties or publicly available sources.

A. Direct Interactions

In accessing, using, or registering with the Services or in corresponding with us (including but not limited to via mail, email, fax, or phone), you may directly provide us with certain Personal Data including when you:

  • Create an account on a Site;

The technologies we use for automatic information collection may include:

  • Cookies (or mobile cookies) — A cookie is a small file placed on your smartphone, tablet, computer, or other device. It may be possible to refuse to accept cookies by activating the appropriate setting on your smartphone, tablet, computer, or other device. However, if you select these settings, you may be unable to access certain parts of the Services.
  • Web Beacons — Portions of the Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity). Web beacons can recognize certain types of information, such as cookies, time and date of a page view, and a description of the page where the Web beacon is placed. We may use Web beacons to compile information regarding use of the Services.
  • Analytics — We may utilize third party companies and analytics to help us market, sell, and provide information about our products and services; and we may provide your Personal Data to these third-party companies to assist us in conducting business with you. We may use web analytics tools provided by service providers, including, but not limited to, Google Analytics, which is a third-party service that transmits website traffic data to Google servers in the United States. Google Analytics does not identify individual users or associate your IP address with any other data held by Google. We may use reports provided by Google Analytics or other similar service providers, to help us understand traffic on the Services, and web page usage. We may use the information provided by these tools to improve our services and our online advertisements. These tools place session and persistent cookies in your browser to identify you as a unique user the next time you visit, access, or use the Services. Each cookie cannot be used by anyone other than the service provider (e.g., Google Analytics).

At this time, the Services do not recognize automated browser signals regarding tracking mechanisms, such as “do-not-track” instructions. Unless automated browser signals regarding tracking mechanisms are in place, all traffic is treated as equal and processed the same in that we will track users’ use of the Services as well as the webpage that the user came from before reaching the Services and the webpage to which he or she went after leaving the Services. C. Information from Third Parties

To the extent permitted by applicable data protection laws, we may also receive information (including Personal Data) or draw inferences about you from other sources such as analytics providers (such as Google Analytics), advertising networks (such as Google Remarketing), and third-party lead collection systems.

To the extent permitted by applicable data protection laws, we may link some of the information we receive from you third parties or publicly available sources with information we obtain through other methods and vice versa. Any such information so linked or combined which meets the definition of Personal Data will be treated as such under this Privacy Policy.

4. How We Use Your Personal Data

Inpro may use your Personal Data in the following circumstances:

  • Where we need to perform the contract we are about to enter or have entered with you;
  • Where it is necessary for our legitimate interests and your interests and fundamental rights do not override those interests;
  • Where we need to comply with a legal or regulatory obligation; or
  • Where you have affirmatively consented to its use.

Inpro may disclose Personal Data when it determines it is necessary to comply with applicable laws or regulations; in connection with a merger, acquisition, asset purchase, joint venture, or sale of Inpro, or to protect the interests or safety of Inpro, its customers, or other visitors to the Services.

B. Change of Purpose

We will only use your Personal Data for the purposes for which we collect it unless we reasonably consider that we need to use it for another purpose which is compatible with the original purpose. Please note that we may process your Personal Data, in compliance with the above rules, where such processing is required or permitted by law.

The Services may offer features and services that are administered or provided by third parties hired by Inpro. To receive these services, you may be required to provide these third parties with Personal Data. Such services may be subject to separate terms and conditions established by such third-party providers, including separate privacy policies which may be different than this Privacy Policy.

5. Disclosures of Your Personal Data

We may disclose Non-Personal Data, including information derived from Personal Data which has been sufficiently aggregated or de-identified such that it is no longer capable of identifying individuals, without restriction.

Except as prohibited by law or as otherwise provided in this Privacy Policy, we may share your Personal Data with third parties for the purposes set forth in Section 4 as well as:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep Personal Data confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us about our users is among the assets transferred.
  • To other third parties with your consent or at your direction (e.g., to a third-party installer of Inpro products in order to facilitate installation).
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce our rights arising from any contracts entered into between you and us, and for billing and collection.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Inpro, our customers, or others.

6. Privacy Choices

We strive to provide you with and inform you of choices regarding your information, including Personal Data. This Section 6 describes mechanisms for you to control certain uses and disclosures of your information.

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Promotional Offers from Inpro. If you do not wish to have your contact information used by Inpro to promote our products or services, you can opt-out by checking the relevant box located on the form on which we collect your data (such as the applicable order  or registration form) or at any other time by logging into the Services and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to one of the contact methods provided in Section 1.B. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to Inpro as a result of a product purchase, warranty registration, product service experience or other transactions.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website. For information on accessing or correcting your Personal Data which we hold, please see Section 7.

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request by email to the address listed in Section 1.B.

If you are an individual who is located in the European Economic Area (EEA), please see Section 10 for more information about your rights and choices regarding your Personal Data.

If you are a resident of the state of California, you may have additional rights and choices regarding your Personal Data. Please see Section 11 for more information.

7. Accessing and Correcting Your Personal Data

You can review and change certain Personal Data we hold by logging into a Site and visiting your account profile page.

You may also contact us as provided in Section 1.B to request access to, correct or delete any Personal Data that you have provided to us. Except as required by applicable law, we will not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you are an individual who is located in the European Economic Area (EEA), please see Section 10 for more information about your rights and choices regarding accessing, correcting, and deleting your Personal Data.

If you are a resident of the state of California, you may have additional rights and choices regarding accessing, correcting, and deleting your Personal Data. Please see Section 11 for more information.

8. Data Security

We have put in place appropriate physical, technical, and administrative security measures to prevent your Personal Data from being accidentally lost, used or accessed in an unauthorized way, altered, or disclosed. However, no medium of communication, including the Internet, is entirely secure, and Inpro cannot guarantee the security of any Personal Data that is disclosed online. We have put in place procedures to deal with any suspected data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

9. Retention of Personal Data

Inpro will retain your Personal Data to fulfill the purposes for which it was collected.  Inpro may also retain and use the Personal Data as necessary to comply with its business requirements, legal obligations, resolve disputes, protect its assets, and enforce its agreements. We will only retain your Personal Data for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, business, or reporting requirements.

10. Notices for Individuals Located in the EEA

A. Scope

This Section 10 applies exclusively to visitors and users of the Services who are located in the EEA or who are otherwise considered “data subjects” under the EU General Data Protection Regulation or similar applicable law (“Data Subjects”).

B. Rights of Data Subjects

If you are a Data Subject, you have the following rights:

  • Request access: commonly known as a “subject access request”, enables you to receive a copy of the Personal Data we hold about you and the purposes for which it is being processed.
  • Request correction: enables you to have any incomplete or inaccurate Personal Data we hold about you corrected, though we may need to verify the accuracy of the new Personal Data you provide us.
  • Request erasure: generally enables you to have your Personal Data deleted or removed.
  • Object to processing: you can object to our processing your Personal Data when you feel it impacts on your fundamental rights and freedoms.
  • Request restriction of processing: enables you to suspend the processing of your Personal Data in the following scenarios: a) if you want us to establish the Personal Data’s accuracy; b) where our use of the Personal Data is unlawful but you do not want us to erase it; c) where you need us to hold the Personal Data even if we no longer require it as you need to establish, exercise or defend legal claims; or d) you have objected to our use of your Personal Data but we need to verify whether we have overriding legitimate ground to use it.
  • Request transfer of data: we will provide your Personal Data to you or a designated third party in a structured, commonly used machine-readable format.
  • Withdraw consent at any time: enables you to remove your consent where we are relying on it to process your Personal Data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is would occur at the time you ask to withdraw your consent.
  • If you have an unresolved privacy concern related to Personal Data collected, processed, or transferred to Inpro, you have the right to submit a complaint to a supervisory authority.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We will try to respond to all legitimate requests within one month. Occasionally it may take us longer if your request is complex or you have made a number of requests.

C. Transfer of Personal Data 

The Services are operated and managed on servers located and operated within the United States. Any information collected through the Services as described in this Privacy Policy may be stored in the United States or any other country in which Inpro or its service providers maintain facilities. The United States is not recognized as having adequate safeguards by some jurisdictions. If you are located outside of the United States, please note that we may transfer information, including Personal Data, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the United States.

12. Governing Law and Jurisdiction

This Privacy Policy, and Inpro’s collection and use of customer information, shall be governed by, and interpreted in accordance with, the laws of the United States and the State of Wisconsin. Any disputes arising out of this Privacy Policy shall be adjudicated in Waukesha County Wisconsin or a federal court of competent jurisdiction in the Eastern District of the State of Wisconsin.
